BOOKING TERMS & CONDITIONS INCORPORATING CARRIERS CONDITIONS OF CARRIAGE
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY AS ALL PASSENGERS WILL BE BOUND BY THEM
 
1.    The purchase of a cruise or cruise and flight or any other travel service booked at the same time with Salamis Lines is a package within the meaning of Directive (EU)2015/2302 on package travel and linked travel arrangements (hereinafter referred to as the Package Travel Directive). Therefore, you will benefit from all EU rights applying to packages. The Salamis Lines Ltd (herein after referred to as ‘Salamis Lines) will be fully responsible for the proper performance of your package holiday as a whole. Additionally, as required by law Salamis Lines Ltd has protection in place to refund your payments and, where transport is included in the package, to ensure your repatriation in the event that it becomes insolvent.

2.    All cruises are offered for sale by Salamis Lines Ltd  (“Salamis Lines”) located at SALAMIS HOUSE, 1, G. Katsounotos Str., P.O.Box 50531, 3607 Limassol Cyprus which is the “Organiser” under the Package Travel Directiveof the Cruise and the Carrier as defined under Annex 1 of Article 1 of EU 392/2009 of the Passenger Liability Regulation (PLR) on the liability of carriers of passengers by sea in the event of accidents

3.    All references to “Carrier” shall include the registered owner and/or Charterer whether Bare Boat/Demise Charter, Time Charterer, Sub-Charterer or operator of the vessel to the extent that each of them acts as Carrier or performing Carrier their servants and or agents of the cruise vessel, any substitute vessel, any tender or other means of transport provided by the Carrier to the Passenger.

4.    Package travel contract means the cruise when sold on its own or when sold at the same time as other transport/ flight and or other tourist services.

5.     Whether you book alone or as a group, you will be entering into a contract directly with Salamis Lines on behalf of yourself and on behalf of all other members of your party.

6.    You must be 18 years old at the time of booking and have the legal capacity and authority to book on behalf of all members of your group.

7.    Reference to a “Passenger” means everyone on the booking.

8.    Anyone under 18 years old is a minor and must be accompanied by a parent or legal guardian and the booking contract must be made by the parent or legal guardian. These conditions apply to all minors.

9.    In case that minor Passengers are accompanied only by one of the parents, a letter of consent from the other parent must be submitted 14 days before embarkation or if the booking is made last minute than during embarkation. In case the minors are accompanied by adults other than their parents the letter of consent signed by both parents must be submitted. The letter of consent must bear the full names, passport or identity card numbers, contact numbers and the parents’ signatures. In both above cases the consent MUST bear an official certification of the parents signatures authenticity.

10.    CONTRACT AND DEPOSIT - Your contract is with Salamis Lines Limited.
At the time of booking a non-refundable deposit of 20% of the total price per person must be submitted as follows:

  1 – 3 days prior to departure – full payment of the holiday price;

 4 – 14 days prior to departure - deposit within 24 hours;

 15 – 30 days prior to departure - deposit within 3 working days;

 31 – 60 days prior to departure - deposit within 5 working days;

 61 + days prior to departure - deposit within 7 working days.

The full payment for the cruise must be settled upon issuing the cruise tickets at the latest 21 days prior to departure date.

If you fail to make any outstanding balance payment as detailed in your confirmation receipt Salamis Lines will have the right to cancel the booking without notice and enforce the cancellation charges shown below, whether the Cruise has been resold or not.

Every Cruise is subject to availability and no contract shall come into existence until the deposit is received in accordance with the timescales above (or, in respect of bookings 1-3 days prior to departure, the full payment is made) and a confirmation receipt is issued.

11.    PRICE AND PRICE CHANGE
The prices shown in this brochure or on our website or other promotional leaflet may have changed by the time you come to book your holiday. Prices, discounts, supplements and special offers advertised in the brochure or elsewhere may be withdrawn or changed at any time prior to you booking. Prices can go up and down; you are, therefore, advised before booking to check with your travel agent or our reservation department for the most up to date price of your cruise or package holiday.  Discounts and special  offers advertised in the brochure or elsewhere are subject to additional terms and conditions and you should read these terms and conditions before booking to ensure that you are well aware of any specific terms or restrictions including any book by dates that may apply to any discounts or special offers

The price of the Cruise includes cabin accommodation for the category booked, breakfast, lunch, dinner and port taxes. A meal is provided for any day long excursions exceeding 8 hours. Not included and do not form part of the Cruise package are excursions , any additional snacks, meals or drinks purchased. Infants under the age of 2 travel FREE (other than Child port taxes which apply to all infants) if they do not occupy a bed/berth. Child prices apply for ages 2 to 12. No monies are refunded for any services which are booked but not used.

12    Salamis Lines prices are based on known costs and projections and it does not expect to have to make any changes. However, Salamis Lines reserves the right to vary prices up or down at any time up to 20 days before departure to allow for variations in: a) exchange rates, b) transportation costs, including the cost of fuel and other power sources and, c) increases in general tax rates (such as VAT) imposed by any country including dues, taxes or fees chargeable for services such as embarkation and disembarkation fees at ports or airports. Salamis Lines reserves the right to impose any of these surcharges and no right of cancellation shall be implied, provided Salamis Lines has notified you at least 20 days before the start of the package If this means paying more than 8% on the holiday price, you will be entitled to cancel your holiday with a full refund of all money paid except for any premium paid to Salamis Lines for holiday insurance and amendment charges. Should you decide to cancel because of this, you must exercise your right to do so within 14 days from the issue date printed in the invoice or such other time as may be specified. Failure to do so will be taken by Salamis Lines that you accept the change in price. Salamis Lines shall refund within 14 days from the time the contract is terminated. If you do not wish to cancel the booking, you can accept the proposed price change.  

13    Should the price of your holiday go down due to the cost changes mentioned above, then any refund due will be paid to you. We will deduct from this refund our reasonable administrative expenses incurred. Please note that travel arrangements are not always purchased in local currency and some apparent changes have no impact on the price of your travel due to contractual and other protection in place.”

14    CANCELLATION OR CHANGES TO THE CRUISE BY SALAMIS LINES

    Arrangements for the holidays are made many months in advance by Salamis Lines.

    Occasionally for some reasons of unavoidable and extraordinary circumstances beyond the control of Salamis Lines the consequences of which could not have been avoided even if all reasonable measures could have been taken it is necessary to make alterations to the arrangements.

    ‘unavoidable and extraordinary circumstances’ means weather conditions, deviation of the Ship due to emergency medical condition(s) and or obligation to save other ship(s), property or individual(s) or life at sea or other emergency unavoidable and extraordinary circumstances beyond Salamis Lines control, any act of God, war or warlike operations strike, lockout or labour difficulties or shortages, civil commotion, lockout or labour difficulties, riot, insurrection, war, government restraint, requisitioning of the vessel, political disturbance, , interference by authorities, requisitioning of the Ship, acts or threats of terrorism, perils of the sea, inability to secure or failure of suppliers, including fuel, port services or any other unavoidable and extraordinary circumstances beyond the control of the Carrier. Explosion, fire, collision, stranding or floundering of the vessel or breakdown or failure of or damage to the vessel or its hull or machinery or fittings or other technical issues which are not th                 e fault of the Carrier.

    Salamis Lines shall not be liable for alteration or cancellation as a result of such events which are (i) attributable to a third party unconnected with the provision of the cruise or (ii) which are extraordinary and unavoidable or (iii) are due to unusual and unforeseen circumstances beyond the control of Salamis Lines, which could not have been avoided with due care or Salamis Lines could not have foreseen or forestalled.  
    Salamis Lines may also cancel your holiday contract and give a full refund to you for any payments made for the holiday, without paying any additional compensation if :
the number of Passengers booked do not meet the minimum numbers required for the cruise to depart on its itinerary and Salamis  notifies you of the cancellation of the holiday contract no later than :-

20 days before the start of the holiday in the case of trips lasting more than 6 days

7 days before the start of the holiday in the case of trips lasting between 2 and 6 days

48 hours before the start of the holiday in the case of trips lasting less than 2 days

In the event of a Significant Alteration prior to departure of an essential term of the Cruise, Salamis Lines will inform you of any cancellation or change of itinerary in writing as soon as reasonably possible and you will be offered a choice of:

a.    To cancel and receiving a full refund or any monies paid; or
b.    accepting the alteration or

booking another Cruise of equivalent or superior quality, if available or booking another Cruise of a lower quality, if available, with a refund of the difference in price.
Salamis Lines shall refund any money paid by you within 14 days from the time the contract is at an end.

You must notify Salamis Lines of your decision in writing within seven days of receiving the notification or alteration or such time as may be reasonably stipulated. Salamis Lines will not be liable with indirect or consequential losses.

You will not be entitled to receive compensation where the Significant Alteration is due to:

a.    an extraordinary and unavoidable  event, the consequences of which could not have been avoided even if all due care had been exercised.

In other circumstances, compensation shall be limited to 30 Euros per person per night for the duration of the Cruise as booked.

In respect of a significant alteration of the Cruise after departure, then Salamis Lines  will make suitable alternative arrangements at no extra cost to you for the continuation of the Cruise. If you do not accept these for good reason or it is impossible to make suitable alternative arrangements, Salamis Lines  will where possible provide you back to the place of departure or to another place to which you have agreed with us. Compensation will not be payable if the alteration is minor or does not affect the value of the Cruise or if Salamis Lines is not able to provide a significant proportion of the package due to an unavoidable and extraordinary circumstance, or is not at fault.
The Carrier cannot guarantee due to any extraordinary and unavoidable circumstance that the Cruise will call at every Port on the itinerary or follow every part of the advertised route or schedule. Cancellation in these circumstances of part of the itinerary, substitution of ports or unavailability of some services on board the vessel will not amount to a significant alteration.

15.     AMENDMENT TO THE BOOKING BY THE PASSENGER
Any cancellation of bookings by you must be made in writing, to Salamis Lines and will be subject to cancellation charges in accordance with the following scale:

Up to 30 days prior to departure - cancellation fee equating to the full deposit amount for the cancelled booking;

29 – 22 days prior to departure - cancellation fee equating to 50% of full price for the cancelled booking;

21 – 7 days prior to departure - cancellation fee equating to 75% of full price for the cancelled booking;

Less than 7 days prior to departure cancellation fee equating to100% of price for the cancelled booking.

If, after our confirmation of your booking has been issued, you wish to change your travel arrangements in any way, for example your chosen departure date or accommodation, we will do our utmost to make these changes but it may not always be possible. Any request for changes to be made must be in writing from the person who made the booking or your travel agent. You will be asked to pay an administration charge of €30, and any further cost we incur in making this alteration.  You should be aware that these costs could increase the closer to the departure date that changes are made and you should contact us as soon as possible. Note: Certain travel arrangements may not be changeable after a reservation has been made and any alteration request could incur a cancellation charge of up to 100% of that part of the arrangements

You have the right to cancel the holiday contract before the start of the holiday without paying any cancellation fee in the event of unavoidable and extraordinary circumstances occurring at the place of destination and significantly affecting the performance of the holiday, or which significantly affect the carriage of Passengers to the destination. In such circumstances you  shall be entitled to a full refund or any payments made for the holiday, but shall not be entitled to additional compensation.
You may transfer your  holiday  contract to another person who can comply with all the terms of the contract, provided Salamis Lines is given 7 days notice in writing before the start of the holiday.   

Where Salamis Lines agrees to the transfer, both you and the substituted Passenger shall be jointly and severally liable for the payment of any balance due and for any reasonable additional fees, charges or other costs arising from the transfer.
Any transfer is valid only for the date, vessel and cruise initially booked  

16.     Cabins are automatically allocated. Cabin numbers will be provided on boarding and in accordance with the category booked. No berth or cabin may be used by a Passenger unless included in the booking. Salamis Lines and the Carrier reserve the right to transfer any Passenger to any berth where at its absolute discretion this is considered necessary.. The vessel does not have any cabins suitable for full time wheelchair users.  

17.     PERSONAL DETAILS/ VISAS/ VACCINATIONS
You will be responsible for the accuracy of the personal details or any other information supplied in respect of yourself and any other person travelling on the cruise you have booked. Where you provide personal details relating to another person travelling on the booking, it is your obligation to ensure that you are authorised to provide such information on the other party’s behalf.  By entering into this contract you agree to pass all information in respect of the booking (including a copy of these booking terms and conditions and our Privacy Policy) or any changes made in relation thereto, to all persons travelling on the booking. All Passengers (infants, children's and adults) must hold their own separate full passports that are valid for the duration of the cruise and must be valid for 6 months after your return date. Salamis Lines are not responsible for obtaining visas for any Passengers this is the responsibility of the individual Passenger.

18     HEALTH REQUIREMENTS AND INSURANCE
The ship visits numerous ports. You are solely responsible for checking with your doctor as to which vaccination or medication are recommended or required for those ports for everyone in your booking and with the vet in relation to anyone travelling with any assistance dogs as to what vaccinations and certificates are required in respect of such dogs.

All Passengers must have adequate insurance cover against termination of the contract by you, or the cost of assistance including repatriation in the event of accident, illness or death, loss of luggage. You should advise name of your own insurer so to indicate to Salamis Lines you have in fact taken out adequate insurance cover.

19.     REDUCED MOBILITY/ DISABILITY
You are asked to provide full details at the time of booking if you or any person travelling in your booking has reduced mobility in order that Salamis Lines can consider whether the cruise holiday and any shore excursion is generally suitable for persons with reduced mobility.

If you have reduced mobility or any disability then in order to enable you to be carried safely you are required to provide as much information as possible at the time of booking.  The Carrier may refuse passage to anyone who has failed to notify of any such disabilities or who, in the Carrier’s and or Master’s opinion, cannot be carried in a safe and or dignified and or operationally feasible manner or where the design of the vessel makes carriage difficult or impossible. In order to avoid disappointment you must always be accompanied by an attendant who will be responsible to provide all care and assistance you may need. The Carrier cannot accept any further responsibility due to your condition. Embarkation / disembarkation at the ports of call will depend on a variety of factors and disembarkation / embarkation will be totally dependent upon the assessment of risk. The carrier’s decision on this will be final. In the interests of safety and in accordance with Article 8 of EU 1177/2010 and in order to enable the Carrier to comply with international, domestic and EU law, we regret that Passengers who are full time wheelchair users and persons who cannot negotiate 2 flights of stairs cannot be carried on board our vessels.  This policy is based on the structure of the vessel as built and in particular the fact that the embarkation deck of the vessel is on deck 5 and Passengers are required to negotiate 2 decks of stairs. There is no elevator which can be used to transport full time wheelchair users to deck 5. The vessel does not call at any port facility with direct facilities for embarkation and disembarkation from deck 5. Passengers with reduced mobility must be able to use the steps easily and safely and unassisted. Neither Passengers nor crew are able, for safety reasons, to carry Passengers in wheelchairs or Passengers with reduced mobility up the stairs, around the vessel or into tenders.   Passengers with reduced mobility may not be able to go ashore at some ports particularly where tenders are to be used. The officer in charge of tender operations can refuse to allow Passengers to use tenders where he believes this would pose a risk to safety. Please note that the vessel has two cabins on Category C with some facilities for disabled passengers but they are not suitable for wheelchairs. These cabins are situated on Venus Deck (Deck 5).

20.     FITNESS TO TRAVEL
 By entering into this Contract you agree on behalf of yourself and every person named on your booking that you are all fit to travel physically and mentally by sea and that your conduct or condition will not impair the safety or convenience of the vessel and/or other Passengers. Any Passenger whose condition may affect their fitness to travel must submit a Doctor’s certificate prior to booking their cruise holiday. Salamis Lines may request further information to be provided by the Passenger’s doctor before agreeing carriage. The decision to carry any Passenger is ultimately that of the Master of the ship based on the opinion of the ship’s doctor.

If it appears to the Carrier, the Captain or the Cruise ship’s Doctor that a Passenger is for any reason unfit to travel, likely to render the Carrier liable for maintenance, support or repatriation, then the Captain shall have the right to refuse to embark the Passenger at any port or disembark the Passenger at any port or transfer the Passenger to another berth or cabin. The Doctor onboard shall have the right to administer first aid and any drug, medicine or other substance and/or admit or confine the Passenger to the ship’s hospital or other similar institution at any port provided that the ship’s Doctor and/or Captain considers that any such steps are necessary. Refusal by the Passenger to cooperate with regard to such treatment may result in the Passenger being disembarked at any port and neither Salamis Lines or the Carrier shall be liable for any loss, expense or compensation to the Passenger.

 Where the Passenger is refused embarkation as a result of health and/or fitness or inability to board the vessel or to travel, the contract shall be treated as cancelled and Salamis Lines shall not have any liability to the Passenger and cancellation fees shall be payable. Salamis Lines and/or the Carrier and/or the health authorities in any port shall be entitled to administer a public health questionnaire on their own behalf. Each Passenger shall supply accurate information regarding symptoms of any illness including but not limited to gastrointestinal illness. The Carrier may deny boarding to any Passenger that it considers in its sole discretion to have symptoms of any illness including viral or bacterial illness including but not limited to Norovirus. Refusal by a Passenger to complete the questionnaire may result in being denied boarding. Where Passengers become ill onboard the cruise with viral or bacterial illness the ship’s Doctor may request them to remain in their cabin for reasons of health and safety.
Refusal to remain in the cabin or otherwise reasonably co-operate or follow the Doctor’s or Captain’s instructions following illness may result in being disembarked at the next port of call.  Salamis Lines shall not have any liability to you or any person travelling with you in the event of denied boarding or disembarkation. You must pay or reimburse Salamis Lines for all resulting costs and expenses including for food, transportation, accommodation, medical and/or repatriation services, including, but not limited to such costs and expenses incurred by or on account of services provided by port agent and other shoreside service providers, including luggage shipping costs

21     MEDICAL FACILITIES
The ship’s Doctor is not a specialist and the ship’s medical centre is not equipped to the same standards as a land based hospital. The vessel carries medical supplies and equipment in accordance with its flag state requirements to treat minor conditions. Neither Salamis Lines, the Carrier nor the Doctor shall be liable to the Passenger as a result of any inability to treat any medical condition as a result. In the event of illness or accident, Passengers may have to be landed ashore by the Carrier and/or the Master for medical treatment.

Neither the Carrier nor Salamis Lines make any representations regarding the quality of medical treatment at any port of call or at the place at which the Passenger is landed. Salamis Lines does not accept liability in relation to medical care or medical facilities received ashore. It is your responsibility and each party travelling with you to ensure that you and they have comprehensive travel health insurance covering medical treatment and repatriation for the duration of the Cruise. It is the Passenger’s obligation and responsibility to seek medical services from the ship’s Doctor should they need such assistance. Medical facilities and standards vary from port to port. Neither Salamis Lines nor the Carrier makes any representations or warranties in relation to the standard of medical treatment ashore.

22     PREGNANCY
    Pregnant women who are at 12 weeks or more of their pregnancy are advised to seek medical advice before travelling at any stage of their pregnancy. Salamis Lines does not have onboard any of their cruise vessels adequate medical facilities for childbirth. The ship’s doctor on board is neither a specialised obstetrician nor experienced in treating such cases. Women having completed the 28 week of their pregnancy should produce a medical certificate confirming that they are fit to travel. The Carrier or Captain of the vessel reserves the right to ask for a medical certificate at any stage of the pregnancy and to refuse carriage if the Carrier or the Captain are not convinced that the Passenger is fit to travel. Should you or any person travelling with you on your booking be pregnant and fail to inform Salamis Lines or the Carrier or Captain of their pregnancy Salamis Lines or the Carrier will not be liable for any loss or injury suffered by the pregnant person as a result of travelling in such condition and without obtaining a valid medical certificate. The Carrier and Captain expressly reserves the right to refuse boarding rights to any Passenger who appears to be in any advanced state of pregnancy and shall have no liability in respect of such refusal.

23     PASSENGER CONDUCT AND SAFETY
    All Passengers have a duty to obey the lawful requests of the vessel’s Captain or delegated officers whilst on board; and for security or other lawful reasons to allow them (with other members of the crew) to search any Passenger, their cabins, baggage and belongings. The Passenger hereby expressly agrees to allow any such search. Passengers must have received all necessary medical inoculations prior to the Cruise and have in their possession all tickets, valid passports, visas, medical cards and any other documents necessary for the scheduled ports of call and disembarkation. No Passenger shall bring on board any vessel or aircraft any goods or articles of a dangerous nature, nor any animals whatsoever. Salamis Lines will be under no liability whatsoever to any Passenger in respect of any breach or non-observance by any Passenger of the provisions of this clause and each Passenger shall indemnify Salamis Lines (in full) against any loss or damage occasioned to Salamis Lines or any third party by any such breach or non-observance by the Passenger. Passenger’s behavior must not compromise the safety, peace and enjoyment of the Cruise by other Passengers. Passengers shall be liable for any damage suffered by Salamis Lines and/or any third party as a result of the Passenger’s failure to comply with his obligations under these booking conditions, including (without limitation) any damage caused to the vessel or its furnishings and equipment, for injury or loss to other Passengers and third parties, and also for all penalties, fines and expenses that Salamis Lines, Carrier or any of its Suppliers may be liable to pay.

24     CUSTOMER COMPLAINTS
Salamis Lines accepts responsibility for providing all the elements of the advertised cruise but if it fails to provide what has been booked, you must inform it or its representative without undue delay if you consider that any of the services under the cruise holiday contract has not been performed in accordance with the terms of the contract.  Failure by you to notify Salamis Lines or its representative may be taken into account when determining any price reduction or compensation for damages where such notice would have avoided or reduced the damage.
Salamis Lines shall remedy any lack of performance of the services under the cruise holiday contract raised by you unless:
It is impossible to do so, or will incur disproportionate costs, taking into account the extent of the any lack of performance and the value of the contractual service affected.
Any complaint to Salamis Lines must be notified in writing and no later than 35 days from the end of your holiday.
 25    DATA PROTECTION OF DATA SUBJECT
In order to process the Passengers booking and to ensure that the Passengers travel arrangements run smoothly and that Salamis Lines comply with its legal obligations to perform its holiday contract with the Passengers Salamis Lines requires the Passenger to provide personal data relating to all persons travelling on the booking, including children (data subjects).  Salamis Lines shall collect such personal data in accordance with its privacy and data protection policy in accordance with relevant data protection laws including Regulation (EU) 2016/679 which applies from 25 May 2018.

Personal data means any data relating to the data subject, such as name, e-mail, postal address, date of birth, nationality, passport or ID number, bank or credit card details, biometric data for the purpose of uniquely identifying the Passengers, data concerning health for the purposes of monitoring and alert purposes, the prevention or control of communicable diseases and other serious threats to health, including any special needs/dietary requirements, name and communication details of a person to contact in case of an emergency special category of personal data includes racial or ethnic origin and religious beliefs.

In accordance with its policies Salamis Lines shall only seek such personal data as is necessary to comply with its legal obligations (for example immigration and governmental requests) or to perform its contract with the Passengers safely which includes information relating to medical conditions, reduced mobility or any disability which may be relevant to providing appropriate facilities and or assistance or assessing whether the holiday or any element provided is safe and suitable.
